Terms & Conditions Of This Site
When you use this hotel room reservation request service, you understand
the Bali Hotels & Accommodations Company is simply acting
as a medium between yourself and the hotel(s) / industry hotel room
booking companies we may direct you to, and agree the Bali Hotels
& Accommodations Company are free from any and all civil liability,
howsoever caused. Further, you agree to indemnify them in this respect
and recognise any rights and liabilities are between you and the
hotel(s) alone and shall therefore be governed by the laws of Indonesia
(in the case of a hotel) or by the home country of the industry
reservations agent used.
Where a hotel has allowed us to provide a direct reservations for
them. The Bali Hotels & Accommodations Company believes it has
made sure each hotel has read and thereafter accepts all the terms
and conditions shown here, together with the effects and revisions
thereof, by submitting their details for inclusion in this service
/ web-site. Although they may therefore be deemed to have accepted
the
above, you hereby agree that any non-compliance by the hotel(s)
is a matter solely between you and they. You therefore agree all
such matters are beyond the Bali Hotels & Accommodations Company's
responsibilities and liability. Further, you indemnify the Bali
Hotels & Accommodations Company for any failure on their part
on the basis you are able to ask the hotel(s) to confirm its / their
acceptance of
these terms and conditions on the direct enquiry / reservations
form.
Where hotels wish for certain additional terms and conditions to
apply, the Bali Hotels & Accommodations Company will normally
try to include a note of this on the hotel's details and to ask
the hotel to notify the customer of this upon receipt of a reservation
request. However, any failure thereof shall be a matter solely between
the hotel(s) and you.
The Bali Hotels & Accommodations Company believes it has made
sure each hotel has checked the accuracy of all the relevant statements
made on its web pages and advise us as to any changes or discrepancy.
Although they may therefore be deemed to have confirmed the details
as accurate, you hereby agree that any inaccuracy is beyond the
Bali Hotels & Accommodations Company's responsibilities and
liability. Further, you indemnify the Bali Hotels & Accommodations
Company for any failure on their part on the basis you are able
to ask the hotel(s) to confirm any statement prior to making a reservation
using the direct enquiry / reservations form. You also have the
option to ask other people's opinions as to the accuracy of the
information by posting a question on the Bali Hotels & Accommodations
Company's sister site, the Bali and Lombok Travel Forum.
The Bali Hotels & Accommodations Company believes it has made
sure the hotel(s) will do their part so that reservation requests
are dealt with / responded to within 48 hours of the request being
submitted and to each specified e-mail address. However, you agree
that it is solely your responsibility to follow-up in any and all
events, and to reconfirm with the hotel as necessary. You agree
the Bali Hotels & Accommodations Company shall not be held liable
for any delays or failures howsoever caused.
The Bali Hotels & Accommodations Company believes it has made
sure each hotel agrees to maximum limits regarding deposits and
cancellation charges (they may, of course, use lower limits), and
that they have each agreed to this by making them aware of these
terms & conditions, and that their asking to be included on
the Bali Hotels & Accommodations Company's service signifies
their acceptance
thereof. However, you agree the Bali Hotels & Accommodations
Company is not liable for any non-compliance by the hotel(s) on
the basis you are able to ask the hotel(s) to confirm this prior
to booking using the direct enquiry / reservations form. In the
case the hotel(s) do(es) not have a merchant credit card facility,
you agree any and all payments shall be paid by you in cash, including
any cancellation
charges. Further, you agree that any inability of a hotel to charge
your credit card(s) shall not reduce their claim to any and all
due charges.
The maximum deposit / payment / cancellation charges the Bali Hotels
& Accommodations Company believes it has made sure each hotel
/ villa has agreed to (unless shown on their hotel / villa details
page) are;
Deposit: The equivalent of the first night's accommodation
cost plus any extra charges (such as airport transfers).
Balance: Only once you are at the hotel and preferably at
check-out.
Cancellation: An amount equal to the above deposit. In addition,
if cancellation is made within 30 days of the specified hotel arrival
date, a further charge equivalent to the second night's accommodation
cost is applicable.
No Show: The above plus 50% of the remainder of the reservation
value. In addition, the hotel(s) shall be entitled to rent out the
room(s) without any reference to you or reduction in your liability.
If you are going to be delayed, contact the hotel (or maybe even
us), you should find they are flexible so long as you keep them
informed.
However, you should make sure the hotel / villa has confirmed their
requirements in the above respect to you prior to accepting / confirming
the reservation with them. Any failure of yours in this respect
shall not be our responsibility.
Where a guest has a confirmed reservation with a hotel / villa,
yet fails to honour their commitments as above, and where the affected
hotel has said we may / should. It is the strict and immediate policy
of this service to pursue any person for the above plus damages,
interest (10% compound per month) plus costs and / or to file a
complaint with their local police department and / or the Denpasar
City Police Department for either Internet fraud and / or breach
of contract (as appropriate).
Please note, as genuine guests / travellers should be able to claim
cancellation charges back off their travel insurance company, there
should be absolutely no genuine reason not to pay. We justify this
policy on this, and the basis that hotels may have turned away other
guests / sent staff to the airport to meet such / the few inconsiderate
people who do not show up (or who made the reservation with no
intention of travelling to Bali / staying at that hotel / villa)
and then refuse to pay due compensation to the hotels / villas.
Also, where a guest has made a reservation with a particular hotel
/ villa through this site in addition to making the same reservation
through another reservations service and then fails to cancel the
reservation through us as per our / the hotel's / villa's terms
and conditions, we reserve the right to charge that guest as above
but for our own and exclusive
benefit irrespective of whether they honoured the copy reservation
or not through the other agent(s). All of this can, of course, be
avoided by cancelling in due time and with due consideration.
A reservation shall be deemed, for all purposes, to have been confirmed
if either; a) The guest has made a "New reservation request"
which is confirmed back by the hotel prior to any guest cancellation,
or b) Where the guest has made "Another enquiry type",
been advised by the hotel of availabilty and where the guest then
proceeds with a reservation. Cancellation by the guest can only
be carried out in the manner described within the reservation /
enquiry e-mail they are immediately
and automatically sent. This service is not able to accept cancellation
instructions from the guests in any other fashion.
Where / if / when a reservation value cost estimator is used / available
on the reservations form, the calculation it provides (along with
the copy summary sent to you by e-mail from us) is only an estimation
and can not be relied upon. Guests should ensure the hotel(s) /
villa(s) confirm the actual total and breakdown costs to them when
they reply and accept these are the true costs offered by each hotel
/ villa. Prices shown on the estimator do not constitute an offer
and do not form any
part of your agreement with the hotel(s) / villa(s) or us.
Where villa or hotel reservations are made through agents for the
owners, you agree the terms above relating to hotels shall be applied
to these 3rd parties and you agree to secure, read and abide by
their standard terms and conditions. Hotels and villas that are
booked through these 3rd party agents are clearly differentiated
on the hotel / villas details page (although they may not be on
the reservations form).
Travel / Other Hotel Agents who wish to use this site to
contact hotels and / or villas either for enquiries or on behalf
of their guests, may do so and therefore agree this is on the basis
that;
a) They will ensure / guarantee our relationship with the hotel(s)
/ villa(s) are not affected / diminished and will continue to use
this site for reservations with such villas / hotels thereafter
ad infinitum, or
b) If they wish / attempt to deal with the hotel(s) / villa(s) contacted
via this site independently / directly thereafter, they pay us a
US$500 finders fee per hotel / villa they pursue in this manner
irrespective of whether they actually then have a business relationship
with them.
Many of the photographs and text used on this site were taken /
created by and are the exclusive property of Bali Hotels & Accommodations
Co. and are protected by International Copyright Law. Other web
sites / people may copy photographs / text from this site on the
basis they agree to pay US$500 per photo / paragraph simply by informing
us that they have so copied our material (US$2000 if upon demand
- which means if someone copies our material, does not tell us,
and the we find out!). Anyone wishing to copy any such material
without charge, must first contact us by e-mail
here and we will consider (but not be required to accept) such
requests.
Use of this site's services shall be deemed as your acceptance of
these terms & conditions.
