The agency`s terms of business as they appear on booking contracts are reproduced below.  Commission rates are subject to change and will be agreed with artistes prior to acceptance of bookings.

CS ENTERTAINMENTS - TERMS OF BUSINESS

 

Terms applicable to both Promoter and Artiste

1. CS Entertainments (the”Booking Agent”) operates as an Employment Agency specialising in the Entertainment Industry  working under the terms of the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (as amended).

2. The Booking Agent acts as the Artiste`s booking agent only and charges a commission to the Artiste for negotiating bookings on behalf of the Artiste. The Artiste is an independent contractor and is not an employee nor a sub-contractor of the Booking Agent. There is normally no charge to the Promoter by the Booking Agent.

3. This booking contract is direct between the Promoter and The Artiste. The Booking Agent is not a party to the contract and accepts no liability for any breach of contract by the Promoter or the Artiste.

4. The Booking Agent accepts no liability for any loss of/damage to property or personal injury arising from negligence or other cause on the part of the Promoter or Artiste or Venue.

5. This booking contract may only be modified or cancelled by mutual consent of both parties in writing i.e. the Promoter and the Artiste. Claims by either party for cancellation/breach of contract may not exceed the original contract fee. Promoters` deposits are normally non-refundable.

6. The Promoter and Artiste agree that any re-bookings within 12 months of the performance date of this contract will be negotiated through the Booking Agent.

Terms specific to the Promoter

7. The Promoter is responsible for checking that the Venue holds a licence for live entertainment performances where required under the provisions of the Licensing Act 2003..

8. The Promoter is responsible for checking whether the Venue has any specific rules or requirements relating to live entertainment performances at the Venue and if so for advising the Booking Agent at the time of booking.

9. The Promoter is responsible for checking with the Venue that the proposed performance is acceptable to the Venue and that adequate facilities are in place for the Artiste`s performance including suitable performance area / staging, changing room facilities, adequate and safe supply of electricity and any other requirement specified in the booking contract.

Terms specific to the Artiste including Commission Policy

10. The Artiste agrees to pay the Booking Agent commission on this booking and any re-bookings at the following rates:

Pubs/Working Mens Clubs/Social Clubs:   % of the gross contract fee

Private and Corporate Functions:  % of the gross contract fee

Subject to a minimum commission of £

11. Any variation from the above commission rates will be agreed in advance between the Booking Agent and Artiste.

12. The Booking Agent may collect the commission direct from the Promoter in the form of a booking deposit or from the Artiste following completion of the booking in which case the commission will be due to the Booking Agent within 10 days of the performance date. Where the Booking Agent receives any fees due to the Artiste direct from the Promoter then the Booking Agent will immediately forward such fees to the Artiste less any commission relating to those fees.

13 The Artiste as an independent contractor is personally responsible for declaring all earnings to the appropriate authorities and for paying tax and national insurance contributions due.

14 The Artiste agrees NOT to issue his/her own business cards and publicity at Venues where the booking has been arranged/negotiated by the Booking Agent. The Artiste agrees to only issue business cards and publicity specifically supplied by the Booking Agent or approved by the Booking Agent or containing the Booking Agent`s contact details only.

15. The Artiste is personally responsible for insuring his/her own instruments and equipment used in performances and for dealing with any claims arising for loss of or damage to own instruments and equipment. The Artiste is also personally responsible for the safe condition of all instruments and equipment used in performances including having all electrical equipment regularly PAT tested.

16. The Artiste is personally responsible for conducting all aspects of a performance in a safe manner and is personally responsible for any loss of/damage to property or personal injury arising from negligence or other cause on the part of the Artiste.

17. The Artiste is personally responsible for arranging Public Liability Insurance (PLI) cover for his/her Act (minimum cover of £2 million normally required) and for dealing with any claims arising for loss of/damage to property or personal injury.

18. The Artiste agrees to indemnify the Agent in respect of any costs expenses or damages (including reasonable legal expenses) incurred by the Agent in respect of any claims against the Agent arising from any breach of contract or tortious act or criminal offence by the Artiste including but not limited to: breach of booking contract, failure to declare or pay any lawfully due tax or payment, death or bodily injury to third parties, loss of or damage to property.
