'BRE Guidelines' revised spring 04 | Trees in Towns II (Govt project)
The consultation is now on the ODPM website, along with the text of the draft 'guidance notes' for LEA officers. It is intended for representative bodies rather than individuals. The Consulation closed on 30th June 2004 and the very similar consultation in Wales, at the end of July. These pages are a record of how we responded.
Before the complaints system can be brought into operation (expected to be towards the end of 2004) there is a need to put in place 'Regulations' governing certain procedural details such as fees which can be charged by LEAs and how appeals against their decisions should be dealt with. Until that time local authorities have no powers to resolve hedge disputes.
The Draft guidance on how local authorities should administer the complaints system is also up for consultation.
'The consultation does not seek views on matters prescribed in the Anti-social Behaviour Act, such as whether councils should be able to deal with complaints about single trees or deciduous trees or shrubs. Rather it considers issues such as the fees that local councils should charge for this service, how they should assess whether a hedge is causing problems and how any appeals against their decision should be handled'.*This paragraph direct from ODPM

BRE Guidelines
The revised 'BRE Guidelines' have also been posted on the web. We can have no further say in the content of these. The 'light based' hedges still look like unreasonably high hedges in many situations but The the 'BRE Guidelines' on light loss do state.
'A simple technique cannot cover every situation,and a section discusses other relevant factors which
might need to be considered'.
