Will of Thomas Durnford

died at All Cannings, Wiltshire October 1668

 

 

In the name of God Amen I Thomas Durnford of All Cannings in the County of Wilts Yeoman being in health of body and of mind and memory perfect: to make and disclaim this my last will and testament in manner and form as following . That is to say first I commend my soul into the hands of Almighty God hoping through the merits of my saviour Jesus Christ to have pardon and forgiveness of all my sins and to inherit Everlasting Life . I committ my body to the ground to be buried at discretion of my Executors and Directors named and as touching the Disposition of my Temporall and Stable Goods I give and dispose thereof as follows.

I will that my depts and funerall charges be paid and Discharged

Item            I give unto my loving son John Durnford my Chattell Leasehold and messuages of

                and to the same belonging to the Appurtennaces called by the name of Wittnefs.

Item           I give unto my loving son John Durnford one feather bed in the Chamber- one

               bedftead in the chamber aforesaid and one bedstead in the loft and one Table Board

               and frame therunto belonging in the Hall and one table board and frame belonging

               in the Chamber below.

Item           I give unto my loving son John Durnford one mault mill and one maulting stone and

               the stones belonging to a Rook stassoll

Item          I give unto each and every one of my Grandchildren the sum of Two shillings and

              sixpence A poito to be paid within one year after my Decease

 

             And all the rest and residue of my personal Estate Goods and Chattels I do give

              and beqeuath unto my loving Daughter Martha Pottinger wife of Geffery

              Pottingerfull and sold by Executrix of this my last will and testamen.

             And I do hereby annul and do make void all former wills and testamens by me

             heretofore made . In witness thereof of the said Thomas Durnford to this my last

             will and testamen have set my handand soul the Seventh Day of March in the year

             of our Lord God 1681

Thomas's will originally lodged with Trowbridge County Record Office, but, now missing - inventory only survives: -

Thomas "died recently"', buried 02 October 1686 - P perfitt inventory of the goods and chattels of Thomas Durnford of All Cannings in ye county of Wilts husbandman who lately deceased taken by us whose names bee under written. His wearing aparall att the value of 4 pounds.

Of corne? in the barne att the value 10 pounds

A little rooke? of hay att the value of 1-10-0d (pounds and schillings)

A leasehold estate caled by the name of Widnesse att ye value of 50 pounds

Of land in ye feilds to be found att value of 3 pounds

The stones for.....& yeatings stone at ye value of 1pound

A malt mill at ye value of 1 pound

Twenty Ffower sheep at ye value of 5 pounds

In the hall on tablebord and frame and one furnis att ye value of 1 pound

In the chamber within the hall one bedstead and on feather bed and bedings to itt belongin and one tablebord and frame and a little sid cobord att ye value of 2 pounds

In the chamber above one bedstead and one chest att ye value of 0-10-0d

The same in all is 79-0-0 79 pounds?

The Will of Margery Durnford (nee Harris) who died in 1711, widow of John Durnford of All Cannings, Wiltshire

 

 

Will of Margery Durnford dated June 6, 1709, proved December 6, 1714. Con Sarum Wilts

.
"In the name of God Amen, the 6th day of June in ye year of our Lord 1709. I Margery Durnford of ye parish of All Cannings in ye county of Wilts widow being sike and weake in body but of perfect mind and memory thanks be given to God for ye same now ralling to mind ye certainty of death and ye uncertainty of its roll do make and ordain this my last will and testament in manner and from following, that is to say.

First and principally I give my soul into ye hands of Almighty God who gave it me and for my body I recommend it to ye to be buried in a Christian and a decent manner at ye discretion of my executor hereinafter named nothing doubting but at ye generall resurrection I shall receive ye same by again by ye mighty power of God and as touching such wordly estate as it has pleased God to bless me with in this life.

I give devis bequeath and despose of ye same in manner and form following.
I give to my daughter Rebecca Durnford my scaufe (note 1)my wol cloath petticoat with a silver galoom on him (note 2) one trunk and frame, two black chairs, one plain chair in ye hall, one gold ring, one silver lased mantle and one white one (note 3) one holland pillow case one square table board in ye kitchin chamber, her feathers ? box, ye bed & bedding it she now layes on.


I give to my daughter Marth Parry my best sauge gown (serge?)
I give to my daughter Mary Durnford all ye rest of my wearing apparell, my wedding ring, one mantle, my best holand pillow case, ye bed & bolster that is not filled, two good blankets and two pewter dishes marked with M & N.
I give to my son Richard Durnford ye bed & bedding that he now layes on, with the leasehold estate to hold for his natural life giving by my will ye trustees hereinafter named power and authority to put ye said Richard's life into ye leasehold estate aforesaid and my will is it after my son Richard his decease that then ye leasehold shall return to my executor hereinafter named.
I give to my son John Durnford ye sum of Five shillings
I give to my son Thomas Durnford ye sum of Five shillings
I give to my son Richard Durnford ye sum of Five shillings
I give to my son William Durnford ye sum of Five shillings
I give to my daughter Rebecca Durnford ye sum of Five shillings
I give to my daughter Martha Parry ye sum of Five shillings
I give to my daughter Mary Durnford ye sum of Five shillings
I give to my son Stephen Durnford ye sum of Five shillings with the large chest standing in ye hall chamber.
All which moneys and legacys herein before mentioned my will is shall be paid and delivered within two months next after my decease.
And of this my last will and testament, I do make and ordain my son Soloman Durnford to be my whole and sole executor making of all ye residue and remainder of all my goods and chattels making and leaving my loveing neighbours John Beake and Stephen Barrett as trustees of this my last will and testament utterly revoking and making void all other wills by me formerly made.
In witness whereof I have hereunto set my hand and seal the day and year first above written.

NOTES 1. (scuafe- a deep wrap-like cape with long ends falling in front)

2. (worn then as a skirt with a gown on top, gown being bodice & skirt all in one open in front to reveal the petticoat; silver galoon - silver threaded braid like feature on petticoat)

3. (like the scuafe, another outdoor clothing - long tent-like garment always worn with a hood shortened in 1730's to become a Mantle; silver lased = silver threads woven together to form the neck fastenings)

The Will of John Durnford   ? - 1775

 

I John Durnford of All Cannings in the county of Wilts. Yeoman do hereby revoke and make void all wills and bequests by me formerly made and do declare my last and testament to be as follows (which is to say) Whereas I am entitled by the custom of the Manor of All Cannings aforesaid to a customary or copyhold messuage or tenement Farm and Living situate and lying in and being part of the Manor of All Cannings aforesaid for the life of myself and my sister Mary And Whereas I am entitled by the custom and the Manor of All Cannings to another Customary or copyhold messuage or tenement Farm land and living situate and lying and being part of the said Manor of All Cannings for the life of myself

 

 

Now I do hereby give devise and bequeath my several Custom or Copyhold messuages lands tenements and livings unto my beloved Wife Hannah to hold to her for and during all the residue of the form and interest which I shall have therein to come at the time of my decease and for the life of my said sister Mary. -------------All the rest and residue of my goods chattles monies sold for money and personal estate of what nature or kind sold and whatsoever lying or being (my debts and funeral expenses being throughout paid and discharged) I do give devise and bequeath to my said wife Hannah and I do make and constitute and appoint my said wife Hannah sole Executrix of this my last will and testament IN Witness whereof I have hereunto set my hand and seal the Sixth Day of April in the year of our Lord One thousand seven hundred and seventy five .

Will of Mrs. Elizabeth Durnford (nee Edwards) 1776 - 1854

 

This is the last Will and Testament of me Elizabeth Durnford of the Chapelry of Saint James in the Parish of Bishops Cannings in the County of Wilts. Widow as follows that is to say I give and bequeath unto my Daughters Sarah the wife of Charles Cottle Hannah the wife of James Bullen Martha the wife of George Phillips Dinah the wife of William Robinson and Elizabeth the wife of James Milsom and Mary Durnford to be equally divided between them All my household goods and furniture plate linen china and books and every other article of a household nature that may be in and about my dwelling house at the time of my decease (subject to the payment of my funeral expences) for their own use and benefit absolutely And as to all the rest residue and remainder of my real and personal estate whatsoever I give devise and bequeath the same unto Samuel Whitchurch of Devizes in the said County Ironmonger and Edward Sedgfield of the same place Grocer their heirs executors administrators and assigns according to the nature of the said estates and property respectively Upon the several trusts and to and for the several ends intents and purposes hereinafter declared concerning the same that is to say UPON TRUST that they the said Samuel Whitchurch and Edward Sedgfield and the survivor of them and the heirs Executors and Administrators of such survivor do and shall as soon as conveniently may be after my decease sell and dispose of my said real and personal Estates either together or in several lots and either by public Auction or private Contract as they or he my said Trustees or Trustee shall think best And also make execute and perfect all necessary deeds writings and assurances for the purpose of vesting the same Estates hereditaments and premises in any Purchaser or Purchasers thereof or in such person or persons and for such uses intents and purposes as he she or they shall direct or appoint And I hereby declare and direct that the receipt or receipts of my said Trustees or Trustee or of the acting or only acting Trustees or Trustee of this my Will for the time being shall be good acquittances and discharges to the Purchaser or Purchasers of the said Estate hereditaments and premises or of any part thereof for all or any of the money which shall be by them or him paid for the same or so much thereof as in such receipt or receipts shall be acknowledged to be received and that no such purchaser or purchasers after paying his her or their purchase money to the said Trustees or Trustee shall be answerable for the application or in any respect accountable for the misapplication or nonapplication of the same or any part thereof. And I do hereby further will and direct that they the said Samuel Whitchurch and Edward Sedgfield and the Survivor of them and the executors and Administrators of such survivor do and shall stand possessed of and interested in the money arise by such sale or sales as aforesaid IN TRUST to pay these out unto my Sons John and Thomas the sums of Thirty Pounds each And after payment of the aforesaid legacies and all my just debts and the charges of proving and executing the trusts of this my Will I hereby direct that the said Samuel Whitchurch and Edward Sedgfield and the survivor of them and the executors and administrators of such survivor shall stand possessed of and interested in the remainder of the money to arise by such Sale or Sales as aforesaid IN TRUST to divide the same equally between and amongst my sons Daniel and Rueben and my said daughters Sarah Cottle Hannah Bullen Martha Phillips Dinah Robinson Elizabeth Milsom the said Mary Durnford and Mary Augusta Durnford the illegitimate child of my deceased Daughter Charlotte Caroline Augusta Durnford provided that they shall be living at the time of my decease and in case either of them shall die in my lifetime leaving lawful issue then in trust to pay assign and transfer the part or share of him or her so dying unto and to be equally divided between such issue if more than one when and as soon as they shall severally attain their respective ages of twenty one years and pay and apply the dividends interest and annual produce thereof in the mean time for and towards their respective clothing maintenance and education but should either of my said Sons or Daughters or the said Mary Augusta Durnford die in my life time without leaving lawful issue then I direct that the part or share of him or her so dying shall go and accrue to the survivors or survivor of them equally between them share and share alike And I do hereby further direct that the shares of my said Daughters shall be paid to them for their absolute use and benefit and that the same shall not be liable to the debts control or engagements of any husband they or either of them may have and their receipts alone notwithstanding their coverture shall be sufficient and full discharge for so much money as in such receipt or receipt shall be acknowledged or expressed to be received And as respects the part or share of the said Mary Augusta Durnford if she be under the age of twenty one years at the time of my decease it is in that event my will and desire that the sane shall be paid to my Daughter Mary Durnford whose receipt shall be a sufficient discharge to my said Trustees for the same UPON TRUST to expend the same for the benefit of the said Mary Augusta Durnford in such way as she shall consider best and fully rely upon her using her utmost ability for the preferment and advancement in the world of the said Mary Augusta Durnford PROVIDED ALWAYS and it is my desire that it shall be lawful for my said Trustees or Trustee for the time being to pay and apply any part of the share or shares of the respective issue of any of my said Sons and Daughters who shall die in my life time for the putting or placing her or them or any or either of them to or in any trade business or employment or otherwise for her their or any or either of their preferment or advancement in the world notwithstanding the part or share or parts or shares of her them or any or either of them shall not have become payable PROVIDED ALSO and it is my further desire that in case the Trustees or Trustee herein named or appointed or either of them or any succeeding or other Trustees or Trustee of the said premises shall depart this life or shall refuse or neglect to act in the trusts aforesaid it shall be lawful for the surviving or continuing or only acting Trustee for the time being at any time as there shall be occasion to nominate and appoint any other person or persons to be a Trustee or Trustees in the place or stead of the Trustees or Trustee so dying or refusing or neglecting to act as aforesaid for all or any of the trusts or purposes in this my Will expressed And it is my will and meaning that my said Trustees or Trustee for the time being or either of them shall not be liable to answer or make good any loss or losses that shall or may happen to the aforesaid estates and effects or otherwise relating to or concerning the execution of the several trusts aforesaid unless the same shall appear to happen by or through their or either of their wilful neglect or default nor shall either of them be answerable or accountable for the acts deeds receipts or disbursements of the other of them but each of them shall be answerable only for his own separate acts deeds receipts and disbursements And I do hereby direct that my said Trustees or Trustee for the time being shall and may pay and reimburse themselves and himself out of the aforesaid trust monies all reasonable and necessary costs and expences whatsoever that they or the trusts hereby in them reposed And lastly I do hereby nominate constitute and appoint my said Trustees the said Samuel Whitchurch and Edward Sedgfield joint executors of this my Will and I do hereby revoke all former wills by me at any time heretofore made and do declare this only to be my last Will and Testament In Witness whereof I the said Elizabeth Durnford the testatrix have to this my last Will and Testament contained in four sheets of paper set my hand to the first three sheets thereof and my hand and seal to this fourth and last sheet this twenty first day of October in the year of our Lord One thousand eight hundred and forty five.
