Corporate Manslaughter Legislation

Corporate responsibility and Duty of care is a major business issue and nowhere more so than in the arena of driving on business.

The need for road safety policies is stark, as there are 3 million company car drivers and a further 5 million drivers who carry out work-related journeys in their private cars. The proposed revisions to corporate manslaughter legislation have helped drive this issue up the corporate agenda.

Driving Services can help you meet your Duty of Care obligations in relation to Driving at work with our fleet driver training.

Work Related Road Safety

If a person is driving on behalf of your business, they are classed as being ‘at work’. You, and the employee have a ‘duty of care’. In order to comply with that ‘duty of care’ you will require a Work Related Road Safety Policy and safe system of work, including the following areas.

  • Senior management having defined responsibilities for managing Work Related Road Safety.
  • Have organisational structures, which allow effective communication of Work Related Road Safety between departments.
  • Ensure the competency of personnel who are required to drive at work.
  • Evaluate training needs in relation to Work Related Road Safety.
  • Identify appropriate Health and Fitness considerations, and provide advice for personnel who drive at work.
  • Consider ergonomic and safety factors when purchasing vehicles.
  • Ensure your vehicles are fit for purpose.
  • Provide appropriate safety equipment and provide ‘safety critical’ information.
  • Evaluate and risk assess routes and ensure appropriate scheduling to minimise fatigue.
  • To evaluate the suitability and measure the effectiveness of the Work Related Road Safety programme.

  • Maybe they are a relatively inexperienced drivers, having passed your test a little while ago and haven't driven since! (Would you put these people in your company Vehicles)
  • Maybe you took your driving test a long while ago and haven't needed to drive much until now
  • Maybe your new job means that you will be driving long distances - perhaps, in part on motorways!
  • Maybe you are reluctant to park your car:
Reversing between vehicles on the left-hand side of the road
Reversing between vehicles on the right-hand side of the road
Parking between cars in a car park
  • Maybe you are anxious about driving a larger vehicle - a MPV or a minibus
  • Maybe you wish to drive a manual or an automatic geared vehicle
  • Maybe you have had a road accident and wish to overcome the associated traumas.
